To check an employee’s right to work in the UK, employers must carry out a right to work check in line with Home Office guidance.
If the employee is from outside of the UK, employers can usually verify their status by:
- Reviewing their immigration documents – such as passport with visa, or other approved documents; or
- Using the Home Office online checking service if the employee has a digital immigration status (eVisa).
The appropriate check must be carried out based on documents from List A or B of acceptable right to work documents.
In the case of an eVisa, the employee should provide you with a share code, along with their date of birth. You can then use this to check their status at www.gov.uk/view-right-to-work.
