Employers are not required to pay fees when submitting or responding to an employment tribunal claim. However, other costs may arise depending on the complexity or nature of the case. If the employer’s defence involves an expert witness, the business will be responsible for covering these fees.
The most significant expense in defending a claim is usually the legal fees paid to a solicitor. These costs include preparing a response to the claim, drafting necessary documents, and representing the business at the tribunal.

Our fees are based on the time it takes to deal with your case, which can vary significantly from case to case. Our hourly rates vary from £150 to £295 plus VAT per hour depending on the experience and level of the fee earner undertaking the work on your case. The time a case takes and therefore the final cost is dependent on factors such as the factual and legal complexity of the matter, the number of witnesses, the quantity of documents which are relevant to the issues and the conduct of the other party in bringing or defending the claim. The time we charge for includes time spent attending to you and others, dealing with papers, correspondence, telephone calls and attendance at the Employment Tribunal.
